Agreement and who we are
These Terms of Use ("terms") are an agreement between you and Gamified Marketing LLC, a [STATE] limited liability company ("we", "us", "our"). We make the SpeakGOAT app for iPhone and Android, the SpeakGOAT Pro subscription, and the website at speakgoat.app. In these terms, "SpeakGOAT" means all of them.
By downloading, opening or using SpeakGOAT, you agree to these terms. If you don't agree, don't use SpeakGOAT.
Our Privacy Policy explains what data SpeakGOAT collects, who receives it and what you can do about it. Please read it alongside these terms.

Who can use SpeakGOAT
- You must be at least 13 years old.
- If the law where you live sets a higher age for using online services without a parent's consent, you must be at least that age. In some countries it is 14, 15 or 16.
- If you are under 18, or under the age of adulthood where you live, you need permission from a parent or guardian. They accept these terms for you and are responsible for your use of SpeakGOAT, including any purchase.
- You must not be barred from using SpeakGOAT by the laws that apply to you.
SpeakGOAT is made for adults who are learning English. It is not made for children.
What SpeakGOAT is
SpeakGOAT helps you practise speaking English by shadowing: you listen to a line from a short video, say it back out loud, and get feedback. It includes:
- Practice clips. Short dialogue videos, split into lines you can listen to and repeat. Some of these scenes are made with AI tools.
- Pronunciation scores. After you say a line, the app estimates how close you were, word by word.
- Conversations with AI characters. Voice calls with Goat, and spoken practice chats with tutor characters. These characters are AI, not real people.
- YouTube videos. You can search for YouTube videos and watch them in YouTube's player inside the app. If a video has English captions, you can shadow its lines.
- Review, reminders and progress. A review queue, practice reminders on your phone, and stats about your practice.
Many features need an internet connection. We may add, change or remove features over time. We try to keep SpeakGOAT working well, but we can't promise it will always be available or free of errors.
Your ID and your progress
SpeakGOAT does not have accounts with a username and password today. The first time you open the app, it creates a random ID for that install. You can see it under "Your ID" in Profile > Settings > Account.
Your progress, scores, review queue, settings and recordings are stored on your phone. We don't keep a copy of them that we could restore for you. This means:
- If you delete the app, use Delete account (in Profile > Settings > Account) or Delete my progress (in Profile > Settings > Data & privacy), or lose or reset your phone, you can lose your progress for good. We can't bring it back.
- SpeakGOAT has no way to move your progress to another phone yet. A backup of your whole phone made with Apple's or Google's tools might include it, but we don't control that.
- If you sign out or use Delete account, the app creates a new ID. If you install the app again, you normally get a new ID too, unless a phone backup brings back the old one.
- A SpeakGOAT Pro subscription belongs to your App Store or Google Play account, not to your ID. Deleting the app or your data does not cancel it.
Keep a copy of your ID. Our servers link the data they hold to that ID, and it is the only way we can tell which data is yours. To ask us to delete it, see Delete your data.
Free plan and SpeakGOAT Pro
SpeakGOAT Pro is a paid subscription. To finish setting up the app and start using it, you need to start the free trial (where offered), buy SpeakGOAT Pro, or restore a purchase. You can't skip this step.
If your subscription ends, you can keep using SpeakGOAT on the free plan, which has limits. The app shows what the free plan includes, what Pro adds, and the current limits, such as how many practice sessions you get each day and how many lines in a session get a score. We may change these limits and features. The app always shows the current ones.
We won't make SpeakGOAT Pro worse during a period you've already paid for unless we have a good reason, such as a legal requirement, a security or abuse problem, or a provider we rely on (for example YouTube or an AI provider) changing or ending its service. If a change like that affects Pro more than slightly, we will tell you before it happens where we can, for example on speakgoat.app or in an update to the app. You can then cancel and ask for a refund for the unused part of your period, as explained under Refunds.
If the app marks a Pro feature as "coming soon", it is not part of Pro until it is available in the app.
Subscriptions, trials and billing
SpeakGOAT Pro comes as a monthly plan and an annual plan. You buy it inside the app through Apple's App Store or Google Play. The store takes the payment, so we never see your card details. We may use a service called RevenueCat to check whether your subscription is active.
Price
The app shows the price of each plan before you buy, and the store confirms it before you pay. Prices can differ by country. Depending on where you live, the price shown may already include taxes, or the store may add them when you pay.
Payment
When you confirm a purchase, the payment is charged to your App Store or Google Play account. If you start a free trial, the store charges you when the trial ends, unless you cancel in time.
Free trial
- Where offered, the annual plan comes with a 7-day free trial. Apple or Google decides whether you can get it. For example, you usually can't get a second trial. The app shows whether a trial is on offer before you buy.
- If you don't cancel in time, the trial turns into a paid annual subscription and the store charges you the annual price. On the App Store, cancel at least 24 hours before the trial ends. On Google Play, cancel before the trial ends.
- If you buy a subscription while a free trial is running, you give up the rest of the trial.
Automatic renewal
- Your subscription renews automatically at the end of each period, monthly or yearly, unless you cancel before it renews. On the App Store, cancel at least 24 hours before the current period ends. On Google Play, cancel any time before your renewal date.
- On the App Store, Apple charges your account for the next period within the 24 hours before the current period ends. On Google Play, Google charges you at the start of each new period.
- Your App Store or Google Play subscription settings show your next renewal date.
How to cancel
Deleting the app, or using Delete account in the app, does not cancel your subscription. Only the store can cancel it:
| Store | Where to manage or cancel |
|---|---|
| App Store (iPhone) | On your iPhone, open Settings, tap your name, then Subscriptions. Or open Apple's subscriptions page. |
| Google Play (Android) | In the Google Play app, tap your profile icon, then Payments & subscriptions, then Subscriptions. Or open Google Play's subscriptions page. |
While you are subscribed, Profile > Settings > Subscription > Manage subscription opens the same store page. When you cancel, you keep Pro until the end of the period you've paid for. After that, the app goes back to the free plan.
Refunds
Apple and Google take all payments. Apple decides all App Store refunds, and we can't issue them. Google Play refunds follow Google's policy, and you can also email us: we can refund a Google Play purchase from our side.
- App Store: ask Apple for a refund at reportaproblem.apple.com.
- Google Play: follow Google Play's refund policy, or email support@speakgoat.app with your Google Play order number.
If you are a consumer in the EU, the UK or another country with similar laws, you may have a legal right to cancel a purchase within a set time. Use the same routes: Apple for App Store purchases, and Google or us for Google Play purchases. Nothing in these terms takes away a refund right that the law gives you.
Price changes
We may change the price of SpeakGOAT Pro. A new price never applies to a period you've already paid for. Apple or Google tells you about a price increase before it applies to your subscription, as their rules require, and in some cases asks you to agree to it. If you don't want to pay the new price, cancel before your next renewal.
AI features
Several SpeakGOAT features use artificial intelligence (AI) and automated speech technology: calls with Goat, chats with the tutors, the check that estimates your English level, and pronunciation scoring. Goat and the tutors are AI characters. In a call or chat, you are not talking to a real person.
AI can be wrong
- Goat and the tutors make up their replies as you talk. A reply can be wrong, out of date, strange or inappropriate. We instruct the AI to stay on friendly English practice, but we can't control every reply.
- Pronunciation scores, level estimates and other feedback are automated estimates. They can be wrong, for example because of background noise, your microphone or the limits of speech recognition.
- They are not the result of an official English test. They don't predict how you will do in any exam, certificate or visa process.
- Nothing in SpeakGOAT is professional advice. It is not legal, immigration, visa, academic, career, medical or financial advice. For decisions like these, talk to a qualified person.
What to keep out of calls and chats
Don't share sensitive personal information with Goat or the tutors. That includes your home address, ID or passport numbers, bank or card details, passwords, health information, and private details about other people.
Who processes your voice
To make these features work, we send your voice, or a text transcript of what you said, to AI and speech providers. Today they include OpenAI (turning what you say to Goat into text, and turning replies into speech), Anthropic (tutor chats, level checks, and Goat's replies in calls) and Microsoft Azure (pronunciation scoring, which may process your recordings). Your phone's own speech recognition may also send your voice to Apple's or Google's servers. The Privacy Policy explains what each one receives.
If you don't want your voice processed this way, don't use these features. You can also turn off SpeakGOAT's microphone access in your phone's settings.
Your recordings and transcripts
When you practise, SpeakGOAT records your voice and turns what you said into text. We call these your recordings and transcripts. They are yours: you keep any rights you have in them.
You give us a limited permission (a "licence") to copy, store, process and send your recordings and transcripts, but only as needed to run SpeakGOAT for you. That means scoring your speech, running calls and chats, showing your progress, and keeping SpeakGOAT working and safe. This licence is worldwide and free of charge. It also covers our service providers when they do this work for us. It ends when the recording or transcript is deleted, except for any copy the law requires us to keep.
We don't sell your recordings or transcripts, and we don't use them to train AI models. If that ever changes, we will ask for your permission first.
While "Keep my recordings" is on in Profile > Settings > Audio & subtitles, your recordings are saved on your phone so you can replay them. We don't keep copies of your recordings on our own servers. The Privacy Policy explains what is sent where and what you can delete.
Acceptable use
Use SpeakGOAT for your own English practice. Don't:
- use SpeakGOAT to break the law, or to harass, threaten, abuse or harm anyone;
- say, type or submit anything unlawful, hateful, sexually explicit or violent, or try to get the AI to produce it;
- try to get around the instructions that keep the AI on friendly English practice, or use the AI features for something unrelated, such as producing material to publish or sell;
- record or submit someone else's voice without their permission;
- try to get SpeakGOAT Pro or its features without paying, for example by tampering with the app, its settings or its purchase checks;
- use someone else's ID, or try to see, change or delete anyone else's data;
- access SpeakGOAT or our servers with bots, scripts, scrapers or any other automated tool, or connect to our servers with anything other than the SpeakGOAT app;
- copy, scrape, download, record or share our clips, lines, captions, translations or other content outside the app;
- copy, modify, reverse engineer or decompile the app, except where the law lets you do so despite this rule;
- overload or disrupt SpeakGOAT, our servers or our providers, or get around any limit we set;
- sell, rent or sublicense SpeakGOAT, let others use it for money, or use it to build a competing product.
If you break these rules, we may limit or stop your access. See Ending these terms.
Videos, YouTube and other content
Content in the app
The clips, lines, captions, translations and other material in SpeakGOAT belong to us, to people who license them to us, or to their owners. Some practice scenes are made with AI tools. Captions and translations can contain mistakes.
You may use this content inside the app for your own practice only.
YouTube
SpeakGOAT uses YouTube API Services. This lets you search for YouTube videos and watch them in YouTube's own player inside the app.
- By using SpeakGOAT, you agree to be bound by the YouTube Terms of Service. When you watch, YouTube collects data under the Google Privacy Policy.
- YouTube videos belong to the people and companies who uploaded them. We don't own or control them, and we aren't responsible for what they contain. YouTube, Google and the video owners don't endorse SpeakGOAT.
- If a video has English captions, SpeakGOAT can split them into lines for you to shadow. The captions come from the video and can be wrong or out of sync.
- A video or its captions can stop working or disappear at any time, for example if the owner deletes the video or turns off embedding. We can't bring it back.
- Links to YouTube or other websites take you to services we don't run, under their own terms.
Copyright complaints
If you believe something in SpeakGOAT infringes your copyright, email support@speakgoat.app with the subject line "Copyright notice". Please include:
- your name, postal address, phone number and email address;
- a description of the copyrighted work you believe is infringed;
- where the material appears in SpeakGOAT, in enough detail for us to find it, such as the screen, the clip title or the YouTube video link;
- a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act for the owner;
- your physical or electronic signature. Typing your full name is enough.
We review every complete notice and remove or disable access to the material where that is the right step. We reply to tell you what we did.
A YouTube video is hosted by YouTube, not by us. We can stop showing it in SpeakGOAT, but to get it removed from YouTube you also need to report it to YouTube.
If you knowingly send a false notice, you may be liable for damages.
Our rights and your licence
SpeakGOAT belongs to Gamified Marketing LLC or the people who license material to us. That includes the app, its design, text and graphics, Goat and the other characters, our clips and lessons, and the SpeakGOAT name and logo. These terms don't give you ownership of any of it.
We give you a personal, limited, non-exclusive, non-transferable and revocable licence to download the SpeakGOAT app and use it on a device you own or control, for your own non-commercial English practice. This licence is subject to these terms and to the rules of the store you got the app from. We keep all rights we don't expressly give you.
If you send us ideas or feedback, we may use them freely, without paying you or owing you anything.
Ending these terms
You can stop using SpeakGOAT at any time by deleting the app. If you have SpeakGOAT Pro, cancel it separately in your store settings.
To delete the data our servers hold for your ID, use Delete account in Profile > Settings > Account, or email support@speakgoat.app with your ID from that screen. We delete emailed requests within 30 days. Copy your ID before you delete the app, because a new install normally gets a new ID. Delete your data explains the steps.
We may suspend or end your access to SpeakGOAT, or to some features, if you break these terms, if the law requires it, or if we need to protect SpeakGOAT, other people or our providers. Unless the law, safety or security needs us to act at once, we will try to tell you before we do this, and why. SpeakGOAT has no accounts, so we may only be able to reach you if you have emailed us.
We may also stop offering SpeakGOAT. If we do, we will stop subscriptions from renewing and, where we can, tell you at least 30 days in advance on speakgoat.app and in an update to the app. You can ask for a refund for any paid time you can no longer use, as explained under Refunds.
Parts of these terms that are meant to last after they end still apply. These include ownership, disclaimers, limits on liability, and governing law.
Disclaimers
To the extent the law allows, SpeakGOAT is provided "as is" and "as available". We make no promises about SpeakGOAT beyond those written in these terms. In particular, we don't promise that:
- SpeakGOAT will always be available, or will work without interruptions, errors or loss of data;
- scores, level estimates, feedback, captions, translations or AI replies will be accurate, complete or right for you;
- using SpeakGOAT will improve your English by a certain amount, or help you pass a test or get a job, a place on a course or a visa;
- YouTube videos or other third-party content will stay available.
To the extent the law allows, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Some countries and states don't allow these exclusions. If you live in one of them, some of the exclusions don't apply to you. For example, consumers in the EU and UK have legal rights when digital content or services are faulty, and these terms don't affect those rights.
Limits on our liability
To the extent the law allows:
- We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, income, data, progress or opportunities, even if we knew they were possible.
- Our total liability to you for all claims about SpeakGOAT or these terms is limited to the greater of: (a) the amount you paid for SpeakGOAT Pro in the 12 months before the event that led to the claim, or (b) 50 US dollars.
These limits apply whatever the legal basis of the claim, including contract, negligence or any other theory.
What these limits don't cover
Nothing in these terms limits or excludes any liability that the law doesn't allow us to limit or exclude. Where the law says so, that includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for gross negligence or wilful misconduct. It also leaves your legal rights as a consumer untouched.
If you are a consumer in the EU or UK
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. Loss or damage is foreseeable if it was obvious that it would happen, or if both of us knew it might happen when you accepted these terms. We are not responsible for loss or damage that is not foreseeable. SpeakGOAT is for personal use, so we are not liable to you for business losses.
Governing law and disputes
These terms are governed by the laws of the State of [STATE], USA, and applicable US federal law, without regard to conflict-of-law rules.
If something goes wrong, please email support@speakgoat.app first, so we can try to fix it.
Any court case about SpeakGOAT or these terms must be brought in the state or federal courts located in the State of [STATE], USA. You and we both accept the jurisdiction of those courts.
If you live outside the US. If you are a consumer, you keep the protection of the mandatory laws of the country where you live. These terms can't take that away. Where those laws allow it, you can also bring a claim in the courts of your own country.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these terms.
Changes to these terms
We may update these terms, for example when SpeakGOAT changes or when the law or store rules change. We will publish the new version on this page and change the "Last updated" date at the top.
If a change materially affects your rights, we will give you reasonable notice before it takes effect, for example on this page or in the app. If you keep using SpeakGOAT after a change takes effect, the new terms apply to you. If you don't agree with them, stop using SpeakGOAT and cancel any subscription.
A change does not apply to a dispute that started before the change.
Apple App Store terms
If you got SpeakGOAT from Apple's App Store, this section also applies. If it conflicts with anything else in these terms, this section wins for the iPhone app.
- Agreement with us, not Apple. These terms are between you and Gamified Marketing LLC only, not Apple Inc. ("Apple"). We, not Apple, are solely responsible for the SpeakGOAT app and its content. Nothing in these terms sets usage rules for the app that conflict with the Apple Media Services Terms and Conditions in force when you accepted these terms.
- Scope of licence. Your licence to use the app is non-transferable and limited to using it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts associated with you through Family Sharing or volume purchasing may also use the app, where those rules allow it.
- Maintenance and support. We alone are responsible for providing any maintenance and support for the app, as set out in these terms or as the law requires. Apple has no obligation whatsoever to provide maintenance or support for the app. For help, see Support.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, that you paid for the app. To the maximum extent the law allows, Apple has no other warranty obligation of any kind for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our sole responsibility.
- Product claims. We, not Apple, are responsible for dealing with any claims by you or any third party about the app or your possession or use of it. These include: (a) product liability claims; (b) any claim that the app fails to meet an applicable legal or regulatory requirement; and (c) claims under consumer protection, privacy or similar laws. These terms don't limit our liability to you beyond what the law allows.
- Intellectual property claims. If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You confirm that: (a) you are not located in a country that is subject to a US Government embargo, or that the US Government has designated as a "terrorist supporting" country; and (b) you are not listed on any US Government list of prohibited or restricted parties.
- Our name and address. Send any questions, complaints or claims about the app to Gamified Marketing LLC, [MAILING ADDRESS], or email support@speakgoat.app.
- Third-party terms. When you use the app, you must follow any third-party terms that apply to you, such as your mobile carrier's data plan and the YouTube Terms of Service.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple will have the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
Google Play
If you got SpeakGOAT from Google Play, your download and any purchase are also subject to the Google Play Terms of Service. Google is not a party to these terms and is not responsible for the SpeakGOAT app. Google Play handles your SpeakGOAT Pro payments, renewals and cancellations under its own terms and policies. Refunds follow Google's policy, and we can also refund Google Play purchases ourselves (see Refunds).
General terms
- These terms, the Privacy Policy and the purchase terms shown in the app when you buy are the whole agreement between you and us about SpeakGOAT.
- If a court decides that part of these terms can't be enforced, the rest still applies. That part is changed only as much as needed to make it enforceable.
- If we don't enforce part of these terms straight away, we can still enforce it later.
- You can't transfer your rights under these terms to anyone else. We may transfer ours to another company, for example if SpeakGOAT is sold, as long as your rights under these terms are not reduced.
- We are not responsible for delays or failures caused by events outside our reasonable control, such as outages at our providers.
- These terms don't create a partnership, employment or agency relationship between you and us.
- If we translate these terms, the English version applies where the two differ, unless the law where you live requires otherwise.
